Telehealth Informed Consent & Standards of Practice
Telehealth Informed Consent Prior to the initiation of services, the practitioner and client agree to the following:
Risks and Limitations: The client understands the potential for technical failures, confidentiality limits inherent in electronic transmission, and the specific limitations of virtual assessment.
Artificial Intelligence Disclosure: In accordance with ethical standards (CAMFT 6.3), the practitioner will disclose the use of any AI-supported tools utilized for documentation, treatment planning, or clinical decision-making.
Licensure Jurisdiction: The practitioner maintains an active California license and provides services only to clients who are physically located in California at the time of the session, unless otherwise permitted by the laws of the client's jurisdiction.
Privacy Standards: All technology platforms used are certified to comply with the Health Insurance Portability and Accountability Act (HIPAA) and the California Confidentiality of Medical Information Act (CMIA).
Clinical Suitability & Ethical Duty The practitioner holds an ongoing duty to assess the "suitability of telehealth" for each client. This includes evaluating whether virtual delivery is clinically appropriate, safe, and effective for the client’s specific diagnosis and situational factors.
Operational Requirements (Start of Each Session) At the beginning of every telehealth encounter, the practitioner shall:
Obtain and document verbal confirmation of the client’s full name.
Obtain and document verbal confirmation of the client’s current physical location.
Document reasonable efforts to identify appropriate local emergency resources relative to the client’s physical location.
Patient Rights and Responsibilities:
As a Licensed Clinical Social Worker, I adhere to the NASW Code of Ethics to ensure the highest level of professional accountability.
Ethical Framework and Anti-Discrimination
Cultural Competence & DEI: In accordance with NASW Code of Ethics Section 1.05, I am committed to practice that respects the dignity and worth of all persons. I am explicitly prohibited from perpetuating historical or social prejudice in the process of diagnosis, assessment, or treatment.
Non-Discrimination: This practice maintains a broad non-discrimination mandate across all aspects of professional engagement.
Continuing Education and Professional Standards:
I certify ongoing compliance with the professional development mandates set by the California Board of Behavioral Sciences.
Telehealth Training: I have completed the mandatory one-time, 3-hour training in the provision of mental health services via telehealth, including law and ethics (AB 1759/SB 1024).
Biennial Requirements: I complete 36 hours of continuing education every two years through Board-recognized providers (such as NASW).
Law & Ethics: Every renewal period includes a minimum of 6 hours of California Law and Ethics. I maintain records showing the specific breakdown of these hours, including telehealth-specific ethics training, to ensure readiness for BBS audits.
Regulatory Disclosure: Privacy and Security
This practice operates as a HIPAA-compliant Covered Entity. Under California Civil Code Section 1798.145, health care providers subject to the Health Insurance Portability and Accountability Act (HIPAA) are generally exempt from the California Consumer Privacy Act (CCPA). Your Protected Health Information (PHI) is governed by the stringent privacy, security, and breach notification rules of federal HIPAA regulations and the California Confidentiality of Medical Information Act (CMIA).
Please note: While PHI is exempt, other non-health-related personal information collected by this website (such as administrative records or marketing cookies) may still be subject to the standard provisions of the CCPA.
